The National Right to Work Legal Defense Foundation has issued a legal notice for King Soopers workers in Colorado who are affected by a strike ordered by United Food and Commercial Workers (UFCW) union officials. The notice informs the approximately 10,000 workers involved about their rights, which include continuing to work during the strike if they choose.

The legal notice aims to clarify options available to employees, emphasizing that union members can avoid fines and punishment imposed by union leaders if they decide to continue working. It states, "The situation raises serious concerns for employees who believe there is much to lose from a union-ordered strike." The Foundation notes that it often receives inquiries from workers seeking guidance on how to avoid penalties for not adhering to strike demands.

Key points of the notice include information on resigning from union membership and revoking union dues check-offs. Additionally, it provides guidance on using a decertification petition to initiate a secret ballot election for removing the union.

Historically, the Foundation has supported King Soopers employees in similar situations. During previous UFCW strikes against King Soopers, Foundation attorneys helped workers defend themselves against what were deemed illegal attempts by UFCW officials to fine them for not complying with strike orders.

Mark Mix, President of the National Right to Work Foundation, stated, "Workers always have the right to continue to work during a strike, despite what union officials may tell them or try to pressure them into doing." He emphasized the organization's commitment over decades "to offering free legal aid" and protecting workers from coercive tactics associated with union strikes.

Mix also reiterated that Foundation attorneys are ready to assist any King Soopers employees facing unlawful retaliation during this current labor dispute.
