Teamsters union officials are seeking to overturn the results of a recent vote by employees at Imperial Bag & Paper Co. in Orlando, Florida, who chose to remove the union as their representative. The effort to decertify the International Brotherhood of Teamsters was led by employee Lionel Powell, with legal support from National Right to Work Foundation staff attorneys.

In July, Powell submitted a petition signed by enough coworkers to prompt the National Labor Relations Board (NLRB) to conduct a decertification election. The NLRB is responsible for enforcing federal private-sector labor law and resolving disputes involving employers, unions, and workers.

The election took place on August 7 among all full-time and regular part-time drivers and shuttle drivers at the Orlando facility. A majority voted against continued representation by Teamsters union officials.

Florida law prevents workers from being fired for refusing to pay union dues or fees. However, unions can still hold exclusive bargaining rights over all employees in a workplace unless removed through a formal process.

After losing the vote, Teamsters lawyers filed objections with the NLRB in an attempt to invalidate the ballot count. They also made new allegations of employer misconduct last week.

“All American workers are entitled to the full protections afforded to them by federal labor law, which include the right to vote out unwanted union officials in a secret-ballot election,” said National Right to Work Foundation President Mark Mix. “Once again Teamsters union bosses are showing that they are more interested in preserving their own power than respecting workers’ rights and choices.”

“Foundation staff attorneys will continue to assist the Imperial Bag & Paper Co. workers until they are freed from unwanted union officials,” Mix added.
