Missouri dispensary workers end UFCW representation after NLRB order

The National Labor Relations Board (NLRB) has issued an order removing United Food and Commercial Workers (UFCW) Local 655 as the exclusive representative for a group of employees at the Shangri-La dispensary in Columbia, Missouri. This action finalizes a legal effort by workers to end union representation at their workplace.

The process began when Travis Hierholzer, with assistance from National Right to Work Foundation staff attorneys, submitted a petition to the NLRB seeking a decertification election. The petition was supported by signatures from nearly all employees at the dispensary. Under federal labor law, if at least 30% of employees sign such a petition, an NLRB-administered election can be triggered to decide whether union representation will continue.

A vote among full-time and regular part-time patient consultants, patient consultant supervisors, and inventory specialists was close to being scheduled for September. Instead of moving forward with the election, UFCW union officials chose to disclaim their status as representatives of the unit, effectively ending their role without a formal vote.

Missouri is one of 24 states that does not have laws making union membership and dues payment entirely voluntary. Before decertification, workers could have been required to pay dues or fees to UFCW officials as a condition of employment.

“Workers across the country, and especially in states where union bosses can force them to pay dues or else be fired, continue to exercise their legal right to free themselves of unwanted union representation,” stated National Right to Work Foundation President Mark Mix. “The National Right to Work Foundation will continue to stand up for American workers wherever they may be, by providing free legal aid to help defend their rights and remove unwelcome union bosses from their workplace.”
