The Mexican Telephone Workers’ Union (Sindicato de Telefonistas de la República Mexicana, STRM), which is affiliated with UNI Global Union, has welcomed a significant decision from the Rapid Response Labour Mechanism (RRLM) Panel under the United States-Mexico-Canada Agreement (USMCA). The panel found that workers at the Atento Services call centre in Hidalgo, Mexico, were denied trade union and collective bargaining rights.

This outcome followed efforts by workers, STRM, and the National Workers’ Union (UNT), marking what they describe as an important milestone for labor rights in Mexico. Francisco Hernández Juárez, General Secretary of STRM, stated: “This achievement belongs to the workers who refused to be intimidated. With their courage and persistence they demonstrated that there are mechanisms to demand a genuine right to unionisation and trade union freedom.”

The RRLM Panel determined that Atento Services engaged in improper interference, discrimination, and created an environment of intimidation against those attempting to exercise their right to organize. The panel also noted that steps taken by Mexican authorities had not been enough to resolve these issues because of repeated non-compliance by Atento.

As a result of this ruling, calls have intensified for a remediation plan involving input from workers, STRM representatives, government officials from the Ministry of Labour and Social Welfare, and company management. Additionally, STRM was granted an injunction against previous decisions made by the Federal Centre for Conciliation and Labour Registration. This legal development paves the way for further examination of irregularities during union representation procedures.

Marcio Monzane, Regional Secretary of UNI Americas, commented on the broader impact: “This ruling sends a strong message to all multinationals: we will not tolerate violations of trade union rights. International solidarity will always stand with those fighting for free and democratic unions. We congratulate STRM for supporting the workers throughout this process.”

The negotiation phase leading up to USMCA’s adoption highlighted differences in social representation between countries involved. Trade unions in both the United States and Canada played key roles during talks from 2017–2019. Organizations such as AFL-CIO pushed for enforceable labor provisions by linking Democratic support in Congress to inclusion of a dedicated labor chapter within USMCA. This advocacy led to stronger measures like the Rapid Response Labour Mechanism being added to address violations related specifically to freedom of association and collective bargaining in Mexico. Their involvement helped lend additional legitimacy and political influence to labor protections within this international agreement.

UNI Americas reiterated its commitment to back Mexican workers as they continue efforts toward defending trade union freedoms and securing authentic collective bargaining rights.
