Japan Airlines 787-9 | Official Website

A couple has sued Delta Air Lines and Japan Airlines over a minor aircraft collision that occurred in February at Seattle-Tacoma International Airport (SEA). The lawsuit was filed by Herrmann Law Group, a Tacoma, Washington-based law firm.

“Non-fatal injuries in aviation result from major safety failures at multiple levels. Airlines will often try to downplay these types of incidents, describing the injuries as 'minor. ' To people suffering life-long consequences, these injuries are not 'minor,'” said Herrmann Law Group. “Our firm has a long history of holding those responsible accountable and fighting to ensure flyers get the justice they deserve. ”

The lawsuit did not specify the plaintiffs’ injuries. However, Lara Herrmann, an attorney at Herrmann Law Group, noted that considering the weight of the Japan Airlines aircraft—a Boeing 787-9—which struck the Delta Air Lines Boeing 737-800 sideways, the collision could have resulted in “serious spinal sprains and strains,” according to KIRO 7.

The incident occurred on February 5 when the Japan Airlines 787-9, registered as JA868J, had just landed in Seattle following a flight from Tokyo Narita International Airport (NRT). It struck the Delta Air Lines 737-800 while taxiing. The impact sliced through the tail of the 737-800, including its rudder, rendering both aircraft out of service.

Delta Air Lines reported that all passengers disembarked safely without any reported injuries following the incident. Flightradar24 data showed that since then, the Japan Airlines 787-9 returned to service on March 11 after flying from Seattle to Tokyo Haneda Airport (HND) for final checks before resuming passenger flights.

On March 11 and March 12, Japan Airlines deployed flights between Tokyo- Haneda/Dalian Zhoushuizi International Airport (DLC) and Tokyo-Narita/Jakarta Soekarno Hatta International Airport (CGK), respectively. The same journeys were repeated on March 13.

Meanwhile, Delta Air Lines' Boeing 737-800 remains grounded in Seattle since its last flight on February 4.

Herrmann Law Group's website highlights their extensive experience representing passengers and victims' families following aviation incidents or accidents. This includes winning confidential sums in high-profile cases such as two Boeing MAX fatal crashes and Asiana Airlines flight OZ214 which crashed while approaching San Francisco International Airport (SFO) in July claiming three lives.

According to Hermann Law Group's website most flight attendants and passengers on Asiana Airlines flight were fully compensated for a confidential amount.
