A United Airlines passenger has initiated legal action against the airline following an incident involving a suitcase falling from an overhead bin during a flight in 2023. The passenger, Eugenia Lyashenko, claims that the cabin crew failed to secure the luggage properly, resulting in injuries to her head, neck, and back.

The lawsuit was filed in Massachusetts federal court and is based on the Montreal Convention. This treaty holds airlines liable for passenger injuries unless they can prove all appropriate measures were taken to prevent such incidents. According to reports from Business Insider, the incident occurred on a flight from Boston Logan International Airport to London Heathrow Airport.

Lyashenko argues that flight attendants should have intervened to ensure proper stowage of the heavy roller suitcase. She seeks unspecified damages for medical bills, lost earnings, and non-economic losses like pain and mental anguish.

Previous cases under the Montreal Convention have resulted in significant compensation for passengers injured due to airline negligence. In one instance, a Ryanair passenger received over $30,000 after an injury involving an aircraft staircase.

United Airlines has not yet commented on this lawsuit. If successful, Lyashenko's case could prompt airlines to enforce stricter protocols regarding carry-on luggage storage in cabins.
