Two groups of Dallas-based workers have successfully removed the International Brotherhood of Teamsters Local 745 as their bargaining representative. Delivery drivers at Restaurant Technologies, Inc. and employees at FCC Environmental Services filed decertification petitions with the National Labor Relations Board (NLRB), seeking to end union representation. Both groups received legal assistance from staff attorneys at the National Right to Work Foundation.

The NLRB oversees enforcement of the National Labor Relations Act and resolves disputes involving unions, employers, and employees. Workers who are dissatisfied with union representation can initiate a decertification process by filing a petition with the agency.

At FCC Environmental Services, Teamsters Local 745 officials attempted to prevent a decertification election by filing several unfair labor practice charges. Despite these efforts, employees proceeded with their campaign to remove the union. The union eventually withdrew all but one objection, which was dismissed by the NLRB Regional Director because it did not affect the outcome of an election in which most employees voted against continued union affiliation.

In the case of Restaurant Technologies, Inc., after workers filed for a decertification vote in April, an election was scheduled for September. Three days before voting was set to occur, Teamsters Local 745 chose not to contest further and relinquished any claim to represent those employees.

These cases reflect a national trend where more workers are seeking to end union representation, particularly involving the Teamsters Union. According to recent NLRB data, one out of every five decertification cases in the past year involved this union.

Mark Mix, President of the National Right to Work Foundation, stated: “More and more, American workers across the country are deciding they are better off without Teamsters union bosses who prioritize their own interests over that of the workers they claim to ‘represent.’ These successful decertification efforts demonstrate what happens when courageous and independent-minded workers assert their rights.”

Mix also commented: “Union bosses often do not speak for the workers under their so-called ‘representation,’ and statistics show that over 90% of employees have never had a chance to vote on the union that purports to represent them. That one in five decertification petitions filed last year involved the Teamsters only drives home the point that workers are increasingly rejecting the union’s coercive agenda.”
